Terms and Conditions
These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User,” “Rider,” “Driver”) and Joiin (“Company,” “we,” “us,” or “our”). By accessing, using, or registering with Joiin, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use Joiin.
1. CONTRACTUAL RELATIONSHIP
Joiin is a technology platform that facilitates cost-sharing among verified working professionals for their commuting needs. Joiin does not provide, operate, or function as a transportation service, common carrier, or taxi provider. All cost-sharing arrangements are voluntary, and users participate at their own risk. These Terms expressly supersede any prior agreements or arrangements with you. Joiin reserves the right to immediately terminate these Terms or deny access to the platform at any time and for any reason. Joiin may amend these Terms from time to time, with any modifications becoming effective upon posting the updated Terms. Continued use of the platform constitutes your acceptance of the revised Terms.
2. USER ELIGIBILITY AND VERIFICATION
2.1 FLEXIBLE USER MODE
Users can toggle between Rider and Driver modes within the Joiin app, provided they have been approved as a Driver. A user may act as a Rider one day and as a Driver another, as long as they meet the respective requirements. Switching to Driver mode requires prior verification and approval.
2.2 ACCOUNT REGISTRATION AND REQUIREMENTS
To access the platform, users must register for an active Joiin account. Users must be at least 18 years old and provide accurate personal details, including name, address, mobile phone number, and work email. A valid payment method must be provided for ride cost contributions and tech fee payments. Users agree to keep their account information up to date; failure to do so may result in suspension or termination of the account. Users are responsible for maintaining the security and confidentiality of their account credentials and for all activities conducted under their account. Each person is permitted only one Joiin account unless explicitly authorized by Joiin.
3. COST-SHARING MODEL (NOT A TRANSPORTATION SERVICE)
Joiin facilitates cost-sharing among Riders and Drivers and does not operate as a transportation service. Riders contribute a fixed per-kilometer rate (e.g., R10/km) to cover fuel and maintenance expenses. Payments made by Riders are reimbursements for costs incurred by Drivers, not earnings. Joiin does not take a commission on ride costs but charges a R5 tech fee per ride for platform maintenance. Joiin merely acts as a payment processor to facilitate reimbursements to Drivers on a weekly basis.
4. PAYMENTS, CANCELLATIONS, AND REFUNDS
4.1 RIDER PAYMENTS
Riders must pay the full cost-sharing contribution before the ride commences. Payments are final and non-refundable once the ride is completed. Riders who fail to make payments will have their accounts suspended or permanently deactivated.
4.2 DRIVER REIMBURSEMENTS
Drivers will receive weekly reimbursements for completed rides, calculated based on distance traveled. Joiin is not responsible for any tax declarations related to driver reimbursements. Drivers acknowledge that Joiin does not provide employment, benefits, or salary payments.
4.3 CANCELLATIONS AND REFUNDS
Riders may cancel a ride before confirmation without penalty. If a ride is canceled after confirmation, cancellation fees may apply. No refunds will be issued for completed rides.
5. VEHICLE OWNERSHIP AND USAGE RESTRICTIONS
Only vehicles personally owned by the Driver may be used for Joiin ride-sharing. Rental, leased, company-owned, or commercially registered vehicles are strictly prohibited. Joiin will verify vehicle ownership and remove non-compliant vehicles from the platform. Vehicles must be roadworthy, fully licensed.
6. GOVERNING LAWS AND JURISDICTION
These Terms and any disputes arising from or related to your use of the Joiin platform shall be governed by and construed in accordance with the laws of the Republic of South Africa. You agree that the courts of South Africa shall have exclusive jurisdiction over any legal proceedings arising out of or relating to these Terms or your use of the platform. Joiin Group (Pty) Ltd operates in accordance with South African laws and regulations.
By using the Joiin platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions. If you have any questions or concerns, please contact us at legal@joiin.co.za.
