These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "Rider", or "Driver") and Joiin Group (Pty) Ltd ("Joiin", "we", "us", or "our"), Registration Number: K2025045231, with registered address at 11 Delville Street, Duncanville, Vereeniging, Gauteng, 1936, South Africa. By downloading, registering, or using the Joiin platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use Joiin.

1. Nature of the Platform

Joiin is a technology platform that connects verified working professionals to arrange voluntary, cost-sharing commutes between their homes and places of work. Joiin is not a transportation company, e-hailing service, metered taxi service, or common carrier. Joiin does not employ drivers, own vehicles, or provide transport. All ride arrangements are made directly between users on a voluntary, cost-sharing basis.

Joiin's role is limited to facilitating connections between users, processing payments, and providing technology tools to coordinate shared commutes. By using Joiin, you acknowledge this distinction and confirm that Joiin bears no liability for the conduct, actions, or omissions of any user during or in connection with a ride.

2. Eligibility and Account Registration

To use Joiin you must:

  • be at least 18 years of age
  • be employed at or associated with a verified organisation
  • register with accurate and up-to-date personal details
  • complete the required identity verification steps
  • maintain a valid payment method on your account

You may only hold one Joiin account. You are responsible for all activity that occurs under your account and must keep your login credentials confidential. Joiin reserves the right to suspend or terminate any account that violates these Terms.

3. Verification

All users are required to complete the following before accessing the platform:

  • Work email verification
  • South African ID verification

Drivers must additionally complete:

  • Driver's licence verification
  • Vehicle registration and roadworthy certificate confirmation (issued within the last 12 months)
  • Banking details verification via Peach Payments

Joiin reserves the right to reject any verification submission and to revoke verified status at any time if we reasonably suspect fraud, misrepresentation, or a breach of these Terms.

4. Access, Licensing and Fees

4.1 Joiin Access Licence

Employers may enter into a Joiin Access Licence agreement with Joiin Group (Pty) Ltd on behalf of their employees. Under a Joiin Access Licence:

  • the employer pays a per-employee monthly licence fee to Joiin as agreed in the licence agreement
  • the employer is responsible for issuing and managing access licences to their employees
  • Joiin verifies and maintains the list of licensed employees on behalf of the employer
  • licensed employees have the platform fee waived on every completed trip for the duration of the licence

A Joiin Access Licence is a commercial agreement between Joiin and the employer. The terms of the licence agreement, including pricing, are agreed separately and are not governed by these Terms. Employees covered by a Joiin Access Licence are still bound by these Terms in all other respects.

Joiin reserves the right to suspend or revoke a licence at any time in the event of non-payment or breach of the licence agreement by the employer. In such cases, affected employees will revert to the standard per-trip platform fee model and will be notified via the app.

4.2 Joiin Wallet

Riders are required to load funds onto their Joiin wallet before requesting a lift. A lift request will only be processed if the Rider's wallet holds sufficient funds to cover the route contribution and applicable platform fee for the requested trip.

Wallet funds may be loaded via Peach Payments using a debit card, credit card, or instant EFT. Joiin does not store full card details on its own servers. Wallet balances are displayed in the Rider's account at all times.

On completion of a trip:

  • the route contribution is deducted from the Rider's wallet and transferred to the Driver's fuel recovery ledger
  • the platform fee is deducted from the Rider's wallet and retained by Joiin (waived for users with an active Joiin Access Licence)
  • the Rider's updated wallet balance is reflected immediately in the app

Wallet balances are non-transferable between users and may not be exchanged for cash except upon account closure, in which case any remaining balance will be refunded within 5 business days.

The maximum wallet balance permitted on any Joiin account at any time is R2,000. Joiin reserves the right to decline wallet top-ups that would cause the balance to exceed this limit. This limit may be reviewed and updated with 30 days notice.

4.3 Route Contributions

All users, whether licensed or not, pay a route contribution per completed trip. The route contribution represents the Rider's share of the Driver's fuel and vehicle running costs, calculated at the prevailing SARS rate per kilometre as published from time to time, applied to the shared route distance.

The route contribution is a cost-sharing reimbursement to the Driver and is not payment for a transport service. Joiin earns no commission, service fee, or per-trip markup from route contribution payments. Route contributions are deducted from the Rider's Joiin wallet on trip completion.

4.4 Platform Fee

Joiin charges a platform fee per completed trip for users who do not hold an active Joiin Access Licence. The platform fee is charged by Joiin as consideration for access to Joiin's technology platform and services only. It is not a charge for transport, a commission on a transport service, or a fee earned from facilitating a commercial transport transaction.

Users covered by a valid Joiin Access Licence issued by their employer have the platform fee waived for the duration of their licence. Platform fee status is displayed in the user's account profile. The platform fee amount is published on the Joiin platform and may be updated with 30 days notice.

The following applies in all cases:

  • route contributions are deducted from the Rider's Joiin wallet on every completed trip regardless of licence status
  • platform fees are deducted from the Rider's Joiin wallet only for users without an active Joiin Access Licence
  • drivers receive the route contribution amount only - the platform fee is retained by Joiin as a technology service charge

4.5 Subscriptions and Cooling Off

Individual access to Joiin for users without a Joiin Access Licence requires an active personal subscription. Subscription tiers and pricing are published on the Joiin platform and may be updated with 30 days notice.

New users receive a free trial period as published at the time of registration. Subscriptions renew automatically each month until cancelled. Users may cancel at any time and retain access until the end of the current billing period.

In accordance with the Consumer Protection Act, 2008, new users may cancel their subscription within 5 business days of registration without penalty and receive a full refund of any subscription fee paid. Users covered by a Joiin Access Licence do not require a separate personal subscription for the duration of their licence. All payments are processed through Peach Payments. Joiin does not store full card details on its own servers.

5. Fuel Recovery

Drivers accumulate fuel recovery through completed rides. Fuel recovery is tracked in the Driver's earnings ledger within the app and reflects the route contribution amounts received from Riders on their completed trips.

Drivers may choose to redeem their accumulated fuel recovery in one of the following ways:

Option 1 - Fuel Vouchers: Redeem accumulated fuel recovery as vouchers redeemable at participating fuel merchants. Fuel voucher redemptions are subject to a minimum redemption amount as published on the platform.

Option 2 - Weekly Fuel Recovery Payout: Accumulated fuel recovery is paid out as a weekly EFT transfer to the Driver's verified bank account. Weekly payouts are processed every Friday and are subject to a minimum payout threshold as published on the platform. The Driver's bank account must be verified through Peach Payments before payouts can be processed.

Drivers may update their preferred redemption method at any time through their account settings. Joiin reserves the right to adjust available redemption methods, minimum thresholds, participating merchants, and payout schedules at any time with reasonable notice.

Fuel recovery balances have no cash value outside the Joiin platform and cannot be transferred, sold, or exchanged between users. Fuel recovery balances will be forfeited upon account termination for breach of these Terms.

The fuel recovery programme is a platform feature currently in development. Joiin reserves the right to adjust, suspend, or discontinue the programme at any time with reasonable notice to affected users.

6. Vehicle Requirements

Drivers may only use vehicles that they personally own or have legal authority to operate for cost-sharing purposes. The following are strictly prohibited:

  • vehicles registered for commercial or for-hire transport
  • metered taxi or e-hailing registered vehicles
  • company-owned vehicles (unless the employer has provided written consent)

All vehicles must meet the following requirements at all times:

  • roadworthy and fully licensed
  • valid roadworthy certificate issued within the last 12 months
  • covered by valid motor vehicle insurance

Drivers are required to confirm with their insurer that their vehicle insurance policy covers passengers in a cost-sharing arrangement before completing their first ride on Joiin. By registering as a Driver, you confirm that you have obtained this confirmation from your insurer. Drivers on Joiin participate in a cost-sharing arrangement only and do not operate for profit. Route contributions cover actual fuel costs only. Drivers are responsible for ensuring their participation complies with all applicable licensing requirements including the National Land Transport Act. Joiin may remove any vehicle from the platform that does not meet these requirements.

7. Insurance, Risk and Safety

7.1 Insurance Requirement and Acknowledgement

You acknowledge and accept that:

  • Joiin does not hold motor vehicle insurance, passenger liability insurance, or any insurance policy covering rides arranged through the platform
  • personal motor vehicle insurance policies in South Africa may not cover passengers travelling in a cost-sharing arrangement
  • it is the Driver's sole responsibility to confirm with their insurer that their policy covers cost-sharing passengers before offering any ride on Joiin
  • Riders accept the risk of travelling in a vehicle whose insurance coverage for cost-sharing passengers has not been independently verified by Joiin

By registering as a Driver, you:

  • confirm that you have obtained written or verbal confirmation from your insurer that your policy covers cost-sharing passengers
  • confirm that you accept full personal responsibility for ensuring adequate insurance coverage for your vehicle and all passengers at all times
  • indemnify and hold harmless Joiin Group (Pty) Ltd, its directors, employees, and agents from and against any claim, loss, damage, liability, or expense (including legal costs) arising from your failure to hold adequate insurance coverage, whether or not such failure was disclosed to Joiin

By registering as a Rider, you confirm that you have read and understood this section, that you accept the insurance risk described above, and that you will not hold Joiin liable for any loss or injury arising from a Driver's inadequate insurance coverage.

7.2 Incident Reporting

Users are required to report any accident, injury, or safety incident occurring during or in connection with a Joiin ride to Joiin within 24 hours. Reports must be submitted to incidents@joiin.co.za and must include:

  • date, time and location of the incident
  • names and Joiin account details of all users involved
  • a description of what occurred
  • any police case number if applicable

Failure to report an incident may affect any claim or dispute arising from that incident. Joiin reserves the right to suspend any user account pending investigation of a reported incident.

7.3 Third Party Liability

Third party liability arising from the use of a vehicle on the Joiin platform rests solely with the Driver and their insurer. Joiin bears no liability for claims by third parties arising from accidents, incidents, or events involving vehicles used in rides arranged through the platform.

Joiin's role is that of a facilitating technology platform only. Joiin is not a party to the ride arrangement and does not assume any liability that would ordinarily attach to a transport operator or employer.

7.4 Roadworthy Certificate

Drivers must provide proof of a valid roadworthy certificate issued within the last 12 months before completing their first ride on Joiin. Joiin reserves the right to request an updated certificate at any time. Drivers whose vehicles do not have a valid roadworthy certificate may be suspended from the platform until the requirement is met.

8. Cost-Sharing, Legal Framework and Technology Services

8.1 Cost-Sharing Framework

All ride arrangements facilitated through Joiin are structured as voluntary cost-sharing commutes between private individuals in terms of the National Land Transport Act (NLTAA). Joiin is not a transport operator and does not hold or require an operating licence under the NLTAA or the Economic Regulation of Transport Act, 2024.

Route contributions are calculated to recover actual fuel and vehicle running costs only. Neither Joiin nor Drivers earn a profit from ride arrangements. Users are responsible for ensuring their own compliance with applicable laws in connection with their participation on the platform.

8.2 Technology Services Separation

Joiin provides a technology platform only. The following are expressly confirmed:

  • Joiin does not dispatch, direct, control, or supervise Drivers
  • Joiin does not set routes, departure times, or pickup points for individual rides
  • Joiin does not guarantee the availability of any Driver or ride
  • Joiin does not employ, contract, or engage Drivers in any capacity
  • Joiin does not own, operate, maintain, or insure any vehicle used on the platform
  • ride arrangements are made directly and voluntarily between users without Joiin's involvement in the individual arrangement

The platform fee charged by Joiin is consideration for access to Joiin's technology platform, matching tools, payment processing, and related software services only. It is not a fee for transport, a commission on a transport transaction, or income from transport operations. This characterisation is consistent with Joiin's position as a technology services provider and not a transport operator under South African law.

In the event that any regulatory authority determines that Joiin's activities constitute transport operations, Joiin reserves the right to immediately modify its fee structure, business model, or operations to achieve compliance, and shall not be liable to users for any resulting changes.

9. In-App Communication

Joiin provides in-app messaging between Drivers and Riders to coordinate ride arrangements. All communication must remain professional, respectful, and limited to the purposes of coordinating commutes. Joiin may monitor or review messages for safety and compliance purposes.

You agree not to use in-app messaging to harass, discriminate against, or engage in inappropriate conduct toward other users. Breach of this section may result in immediate suspension.

10. User Conduct

You agree not to:

  • use Joiin to provide commercial or for-profit transport services
  • harass, threaten, or discriminate against other users
  • submit false, misleading, or inaccurate information
  • tamper with verification, payment, or matching systems
  • create multiple accounts or share your account with another person
  • use the platform in any manner that violates applicable South African law

11. Data and Privacy

Joiin collects and processes personal information in accordance with the Protection of Personal Information Act, 2013 (POPIA). By using Joiin you consent to the collection, processing, and storage of your personal information as described in our Privacy Policy, available at joiin.co.za/privacy.

Your home address is never shared with other users. All pickup and drop-off arrangements take place at designated public route points. Joiin implements reasonable technical and organisational measures to protect your personal information.

Your data rights under POPIA include:

  • the right to request access to your personal information held by Joiin
  • the right to request correction of inaccurate personal information
  • the right to request deletion of your personal information by contacting info@joiin.co.za - requests will be processed within 30 days subject to any legal retention obligations
  • the right to object to the processing of your personal information
  • the right to lodge a complaint with the Information Regulator at www.justice.gov.za/inforeg

In the event of a data breach that poses a risk to your personal information, Joiin will notify you and the Information Regulator as soon as reasonably practicable after becoming aware of the breach, in accordance with POPIA requirements.

If Joiin's data processing infrastructure is hosted outside the Republic of South Africa, Joiin will ensure that such processing complies with POPIA's requirements for cross-border data transfers, including that the recipient country provides an adequate level of protection or that appropriate safeguards are in place.

12. Limitation of Liability

To the maximum extent permitted by South African law, including the Consumer Protection Act, 2008, Joiin is not liable for any loss, injury, damage, or harm arising from or in connection with a ride arranged through the platform, including:

  • road accidents or collisions
  • personal injury or death
  • loss of or damage to property
  • the conduct, actions, or omissions of any user
  • failure of a Driver to arrive or a Rider to be present
  • suspension or revocation of a Joiin Access Licence by an employer
  • delays in weekly fuel recovery payouts due to banking system failures or public holidays

Nothing in these Terms excludes or limits Joiin's liability for death or personal injury caused by Joiin's own negligence, or for fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law under the Consumer Protection Act, 2008.

Joiin does not guarantee the availability, accuracy, or reliability of the platform at all times. The platform is provided on an "as is" basis. Subject to the above, Joiin's total liability to any user for any claim arising from use of the platform shall not exceed the total fees paid by that user to Joiin in the three months preceding the claim.

13. Suspension and Termination

Joiin may suspend or terminate your access to the platform at any time for:

  • breach of these Terms
  • fraudulent, abusive, or unlawful conduct
  • repeated cancellations or no-shows that negatively impact other users
  • failure to maintain required vehicle documentation
  • non-payment of applicable fees
  • any other reason at Joiin's reasonable discretion with reasonable notice where practicable

Upon termination, any outstanding wallet balance will be refunded within 5 business days. Any pending weekly fuel recovery payout due at the time of termination will be processed on the next scheduled payout date unless terminated for breach, in which case accumulated fuel recovery balances will be forfeited.

Where access is terminated due to the expiry or revocation of a Joiin Access Licence by an employer, the user will be notified and given the option to continue on a personal subscription plan.

14. Amendments

Joiin may update these Terms at any time. Material changes will be communicated via the app or email with at least 14 days notice before taking effect. Continued use of the platform after the effective date of any update constitutes acceptance of the updated Terms. If you do not accept the updated Terms you may terminate your account without penalty before the effective date.

15. Complaints and Dispute Resolution

If you have a complaint about Joiin's services, please contact us first at info@joiin.co.za. We aim to acknowledge all complaints within 2 business days and resolve them within 10 business days.

16. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of Joiin will be subject to the exclusive jurisdiction of the South African courts.
